1. Summary

The client, a descendant of a Korean independence activist and a Russian national (“Client”), had been striving to acquire South Korean nationality through the special naturalization system since 2019. Despite seeking advice from various law firms in Korea, the Client faced challenges in properly proceeding with the naturalization process due to physical distance, difficulties in communication with experts, and the COVID-19 pandemic. Eventually, the Client was recommended to approach KORUS LAW, a law firm with a broad regional expertise in Eurasia, and decided to seek our assistance.

2. Our Role

(1) Responsive Understanding of the Facts through Remote Consultation

Considering the unique circumstances of the Client living abroad, we conducted remote consultations to understand the special naturalization procedures and preparations the Client had undertaken so far. In particular, we confirmed that the Client had completed the recognition process for descendants (National Veterans Affairs Agency) through the South Korean Embassy in Russia.

(2) Customized Services for the Client and Close Communication with Relevant Agencies

We grouped the Client and other family members who wished to apply for special naturalization, listing the required documents for each member and providing support to prepare them locally in Russia. Special attention was given to translation and notarization to ensure consistency with the documents and names submitted during the descendant recognition process. Additionally, we maintained close communication with the South Korean Embassy in Russia, the National Veterans Affairs Agency, the Ministry of Justice’s Nationality Division, and the Immigration Office. We informed them of the family’s unique circumstances (such as their study and business commitments in the local area and third countries) and coordinated schedules in advance to ensure that the family’s plans were not disrupted.

(3) Timely Submission of Documents and Progress Monitoring

On the day of the application, we accompanied the Client’s family to the Immigration Office (since nationality acquisition procedures must be performed by the applicants themselves, thus legal representation is not permitted, we provided professional assistance in a supportive role) to submit the special naturalization application. Thanks to the meticulous preparation of the required documents, the application was accepted without any requests for additional information. Considering that the Client’s family primarily resides in Russia, we carefully checked whether the Client’s family could immediately return to their place of residence after submission, or should stay in South Korea for the nationality review and approval, and then prepared for subsequent procedures following the approval of nationality

(4) Approval of Nationality and Issuance of Nationality Certificate Following the Nationality Review

After the nationality review, approval was granted. The Client’s family, who had re-entered South Korea for the subsequent procedures, immediately took the pledge of allegiance and completed the nationality certificate issuance process. As a result, the Client’s family successfully acquired South Korean nationality.

3. Future Plans – Resident Registration, Military Service Exemption Application, etc.

Even after acquiring nationality, procedures such as resident registration, establishing family relations records, and applying for military service exemption still remain. The Client’s family expressed sincere satisfaction with the professional services provided by our team, which were tailored to their specific situation. Therefore, the Client agreed to continue retaining us on further procedures, including undergoing the Foreign Nationality Non-Exercise Pledge and receiving its confirmation certificate, issuance of resident registration cards, and applying for military service exemption.

4. Significance

Since nationality acquisition involves the applicant undergoing the process of becoming a South Korean national, appointing a representative is not allowed, and the applicant must prepare everything from scratch. For applicants who have primarily conducted their economic activities and lived in Russia, it is very challenging to carry out the nationality acquisition process in South Korea while staying abroad. The Client was able to respond swiftly and accurately to changes or inquiries that arose during the process, from the preparation of the application to any issues encountered, through our involvement. As a result, the Client’s family successfully completed the extensive eight-month nationality acquisition process.

Meanwhile, in an era of population decline due to low birth rates, the South Korean government must embrace a historical sense of duty towards overseas Koreans who were scattered due to the past weak national power. It is essential to establish legal and institutional mechanisms to enable their return and settlement in their homeland.

5. Client Review
