[Violation of Narcotics Control Act (marijuana)] Punished by imprisonment for 6 months, but with a suspended execution for 1 year, and supplementary collection of 0.6 million won (second suspension of execution).


1. Background
On December 23, 2020, a Russian national was sentenced to 10-months imprisonment, with a suspended execution for 2 years and a fine of 1 million won for violation of Korea’s Narcotics Control Act (marijuana). However, more than a year later after the final judgment, on February 2, 2022, the same Russian national was prosecuted additionally for two marijuana purchases (which took place in April 2020), which should have been heard within the previous criminal case.

2. Our Value
Even if the final judgment on the suspension of execution has been rendered, a sentence of imprisonment can be imposed as aggravated punishment for the crime that had been committed before the final judgment was rendered. However, we succeeded in bringing out the judgement on second suspension of execution, by asserting that our case applies to the latter event of concurrent offences, and the client completed a drug addiction treatment program and made significant commitment to become part of the Korean society (volunteer works, paying tax, etc.).

3. Second suspension of execution
If a crime is committed either before the judgment on suspension of execution is rendered or during the suspended period of execution, or if the judgment is rendered after the lapse of suspended period of execution, the court may again render its judgment on suspension of execution. The first situation is called the second suspension of execution. Our case can be viewed as an example of the second suspension of execution since we achieved the suspension of execution against the crime which had been committed before the court rendered the judgment on suspension of execution.

Нарушение закона о контроле над наркотиками (марихуана) – лишение свободы (или тюремное заключение) сроком на 6 месяцев, но с отсрочкой исполнения на 1 год (условное осуждение) и с взысканием штрафа в размере 600 000 вон (двойное условное осуждение).

1. Краткое изложение событий
23 декабря 2020 г. гражданин России был приговорен к десятимесячному тюремного заключения с отсрочкой исполнения в течение 2 лет со штрафом в размере 1 миллиона вон за нарушение закона о контроле над наркотиками (марихуана). Более одного года спустя с даты подтверждения приговора в феврале 2022 г. было дополнительно предъявлено обвинение в двухразовом приобретении марихуаны (в апреле 2020 г.), которое должно было рассмотрено в рамках прошлого судебного заседания.

2. Роль KL
Даже если был вынесен окончательный условный приговор по конкретному делу, в некоторых случаях суд может установить более суровое наказание в отношении преступления, совершенного до момента вынесения окончательного приговора. Однако в данном случае мы добились вынести решение об условном осуждении заново, оправдав, что 1) новое обвинение касается однородных действий того же преступления, наказание за совершение которых было уже подтверждено в окончательном приговоре; 2) клиент признает свою вину, прошел программу лечения от наркотической зависимости; 3) прилагает усилия, чтобы стать полноценным членом корейского общества (выполнение волонтерских работ, оплата налогов и т.д.);
