1. Summary

2. Our Role
In practice, foreigners, who have been convicted of a criminal offense involving a fine of over 3 million KRW, are deemed deportable from the country subject to interrogation by the Immigration Office for the subsequent deportation. Therefore, it is natural for foreigners to fear the imposition of administrative measures against them – deportation order, departure enforcement order, departure recommendation, and etc.
We focused on the inevitable personal humanitarian reasons why the client should be allowed to remain in Korea despite being classified as a potential deportee. These included: 1) the fact that the client’s spouse and children had lived in Korea for a long time, 2) the client had a young child under the age of three, 3) the client had no other relatives, so deportation would force the spouse to raise the child alone, impacting his/her livelihood and violating the right to family unity, and 4) the threat of deportation to Russia posed dangers due to the ongoing war and military mobilization in Russia. We compiled and submitted these points, along with other supporting evidence, to the Immigration Office on the day of the interrogation. Additionally, a petition signed by those around the client, a handwritten letter of reflection, and evidence of the client's contributions to Korean society (such as volunteer work) were submitted to emphasize the necessity for the client to remain in Korea.
As a result, we were able to successfully represent the client’s position during the interrogation, and the Immigration Office did not revoke the client’s residency status or issue a deportation order.
