1. Summary

A, a Vietnamese national, married B, a South Korean national, after being in a relationship. As B’s assignment period ended, B returned to Korea alone, and A and B maintained their marriage by meeting two to three times a year. However, prolonged separation caused conflict within the marriage, such as severe arguments, which made B file for divorce in the Korean Family Court.

Although A also wanted to proceed with the divorce, procedural issues, such as the failure to serve A with B’s divorce petition in Vietnam, delayed the divorce proceedings.

A referred the case to KL (KORUS LAW) to expedite the divorce proceedings.

KORUS LAW contacted the legal representative of B to confirm the current status of the divorce proceedings. Based on the fact that A and B entered into an agreement recently, KORUS LAW proposed to conclude the divorce proceedings promptly.

Subsequently, B filed a submission for the case to be referred to mediation. KL appeared at the mediation to represent A and finalised the mediation agreement.

3. Significance

The Court made a decision based on the mediation, taking into account the agreement between the parties and the views of their legal representatives, which led to the swift resolution of the case.

As in the case above, where one party resides overseas, the case can be concluded promptly through mediation with the appointment of a legal representative.
